These terms and conditions outline the rules and regulations for the use of Digital Servicebook (the “Website”), owned and operated by Digital-Servicebook.com ApS (“us,” “we,” or “our”).
By accessing this Website, you accept these terms and conditions in full. Do not continue to use the Website if you do not accept all of the terms and conditions stated on this page.
1. Intellectual Property
Unless otherwise stated, we and/or our licensors own the intellectual property rights for all material on the Website. All intellectual property rights are reserved. You may view and/or print pages from the Website for your own personal use subject to restrictions set in these terms and conditions.
2. Restrictions
You are specifically restricted from all of the following:
- Publishing any platform material in any media.
- Redistribution in any way.
- Selling, sublicensing, and/or otherwise commercializing any platform material.
- Publicly performing and/or showing any platform material.
- Using this platform in any way that is or may be damaging to this platform.
- Using this platform in any way that impacts user access to this platform.
- Using this platform contrary to applicable laws and regulations or in any way may cause harm to the platform, or to any person or business entity.
- Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this platform.
- Using this platform to engage in any advertising or marketing.
If you need special permissions, such as information or examples for news articles or reviews, for the use of Digital Servicebook, please contact us, and we will look at your request on a case-by-case basis.
Use of Digital Servicebook in violation of the above, including forwarding of information from Digital Servicebook, will trigger a penalty of DKK 10.000,00 per violation, just as liability will be incurred under the general rules of the Danish law. As well as closing or termination of any active accounts, depending on the severity of the violations.
3. Your account
To use the services from Digital Servicebook, you are required to create an account with a valid subscription. Registration is allowed if you are a company that is directly or indirectly involved in repair or maintenance of vehicles and/or trailers, vehicle and/or trailer wholesale or retail trade, specialist workshop, road assistance service, vehicle inspection and/or undercoating. If you do not meet these criteria, please contact us, and we will look at your case, and work with you to find a suitable solution. For companies with multiple locations (branches, offices, trading units etc.) each department must be registered separately. The same is applicable for companies with associated companies.
It is the accountholders full responsibility to keep account information correct and up to date. It is the account holder’s responsibility to protect their account against abuse. If the account holder finds out their account has been compromised, the password should be changed immediately and Digital Servicebook should be notified. Upon receiving a notice of an account breach, we’ll launch an investigation to examine the extent of the breach and execute a plan to mitigate and correct potential damage.
4. Content Responsibility
The account holder has full responsibility for the data, they enter on Digital Servicebook is correct. The account holder agrees to fully compensate Digital Servicebook with demands from third party, which is based on the content and data, the account holder has entered.
Digital Servicebook is not responsible for the accuracy and completeness of the information and content from third party providers. Digital Servicebook does periodically perform random checks to see if the information, one can get access to through Digital Servicebook, is correct.
Even though Digital Servicebook continuously work to keep our platforms free of virus and malware, we cannot guarantee that it 100% virus and malware free or assume responsibility in this regard. Before account holders can get data or documentation, they need to carry out reasonable security measures and use appropriate anti-virus programs for their own protection and the prevent Digital Servicebook will be infected.
The data and information on Digital Servicebook platforms are collected in good faith, and we continuously work on having the best data providers available, but the accuracy of the data cannot be guaranteed to be 100% accurate.
Digital Servicebook platforms may contain links or references to/from third party websites. Digital Servicebook assumes no responsibility for the content from such websites and will not use their websites and/or content as their own.
5. Responsibility for Data Processing
It is the account holder’s responsibility to obtain the customer’s/car owner’s consent before providing their data to Digital Servicebook. The customer/car owner must also be made aware of their rights in relation to GDPR, which can be found on Digital Servicebook website, or by pressing the link in the SMS they receive as part of their data being provided to Digital Servicebook. If the customer/car owner does not register their account within 30 days, their information will be deleted from Digital Servicebook.
6. Limitation of Liability
In no event shall Digital Servicebook be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Website, even if we or an authorized representative have been notified orally or in writing of the possibility of such damage.
7. Changes to Terms
We reserve the right to revise these terms and conditions at any time without prior notice. By using this Website, you are agreeing to be bound by the current version of these terms and conditions.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Denmark.
9. Arbitration clause
- Disputes and conflicts: Any dispute, controversy, or claim arising out of or in connection with this contract, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration.
- Arbitration Institute: The arbitration shall be administered by Voldgiftsinstituttet – The Danish Institute of Arbitration in accordance with its rules in effect at the time the arbitration is initiated.
- Arbitrators: The arbitral tribunal shall consist of a minimum of one arbitrator(s). appointed in accordance with the rules of The Danish Institute of Arbitration.
- Place of Arbitration: The place of arbitration shall be Næstved, Denmark, unless otherwise agreed in writing by the parties.
- Governing Law: This contract and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of Denmark.
Confidentiality: The arbitration proceedings and all related information shall be treated as confidential and shall not be disclosed to any third party without the prior written consent of both parties, unless required by law.
